Fanulu respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement committed using our service.
If you believe that your copyrighted work has been copied and is accessible on our platform in a way that constitutes copyright infringement, please provide our DMCA agent with a written notice containing the following information:
Identification of the copyrighted work - A description of the copyrighted work that you claim has been infringed. If multiple works are covered, provide a representative list.
Identification of the infringing material - The URL or other specific location on our platform where the material you claim is infringing is located. Please provide enough detail so we can find it.
Your contact information - Your name, address, telephone number, and email address.
Statement of good faith - A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
Statement of accuracy - A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.
Signature - Your physical or electronic signature.
Counter-Notification
If you believe your content was removed by mistake or misidentification, you may submit a counter-notification to our DMCA agent containing the following:
Identification of the removed material - The URL or description of the material that was removed or disabled.
Your contact information - Your name, address, telephone number, and email address.
Consent to jurisdiction - A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or if outside the US, any judicial district in which we may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
Statement under penalty of perjury - A statement, made under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
Signature - Your physical or electronic signature.
Important Warning
Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys' fees. Do not make false claims.
Repeat Infringers
In accordance with the DMCA and other applicable law, we have adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to our platform and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
Response Timeline
Upon receiving a valid DMCA notice, we will:
Remove or disable access to the allegedly infringing content promptly
Notify the content uploader of the takedown
Provide the uploader with information about filing a counter-notification
If we receive a valid counter-notification, we will forward it to the original complainant and restore the content within 10-14 business days unless the complainant notifies us that they have filed a court action.
