Version 1.0. This Content Provider Agreement ("Agreement") is between Fanulu LLC ("Fanulu", "we", "us") and you, the person who uploads, posts or sells content on fanulu.com ("Creator", "you"). You accept it by ticking the box and selecting I agree before your first upload or sale. It applies alongside our Terms of Service and Community Guidelines. Where they conflict on content, consent or records, this Agreement controls.
1. Eligibility
1.1 You must be at least 18 years old and the age of majority where you live.
1.2 Before you can publish or sell content, you must complete our identity verification. It is run by our provider, Didit, and checks a government-issued photo ID with a liveness check and a face match. You must keep your verification current. When your ID expires, you cannot publish or sell until you verify again.
1.3 You may only operate your own account. You may not let anyone else use it, or upload content on behalf of another person who has not completed verification.
2. Content You May Not Upload, Sell or Promote
2.1 You must not upload, post, sell, advertise or link to any content, or take any action, that:
- (a) is illegal where you are, where Fanulu operates, or where the content is viewed;
- (b) violates the rules of any card network, including Mastercard and Visa, or the acceptable use policies of our payment processors, including CCBill;
- (c) depicts, or appears to depict, anyone under 18, including through role-play, costumes, settings, props or descriptions that suggest a minor;
- (d) depicts non-consensual activity, including real or simulated rape, coercion, or anyone who is or appears to be asleep, unconscious, drugged or otherwise unable to consent;
- (e) was recorded with a hidden camera, without the knowledge of the people in it, or is "revenge porn" or other intimate imagery shared without consent;
- (f) depicts incest, bestiality, necrophilia, extreme violence or other illegal sexual acts;
- (g) promotes or facilitates human trafficking, sex trafficking, sexual exploitation or physical abuse;
- (h) offers, advertises, solicits or arranges escorting, prostitution or any other in-person sexual service, or an in-person meeting between you and a fan, on Fanulu or through links to other sites;
- (i) infringes anyone's copyright, trademark, privacy or publicity rights.
2.2 You must not use titles, captions, hashtags, tags, descriptions or search terms that give the impression your content involves minors, non-consent or any other content in 2.1. Examples include "teen", "schoolgirl", "barely legal", "forced" and similar words. Fanulu blocks many such terms automatically, but you are responsible for your own wording.
3. Everyone Who Appears in Your Content
3.1 Age and identity. Before you produce content featuring any other person, you must check their government-issued photo ID. You must confirm they are at least 18 at the time of production.
3.2 Written consent. Before uploading, you must obtain and keep on record a written consent, signed by each person who appears in the content, to:
- (a) being depicted in the content;
- (b) the public distribution of the content;
- (c) the upload of the content to Fanulu; and
- (d) the content being downloaded by other users, if Fanulu makes downloading available.
3.3 Tagging. You must tag every other person who appears in the content when you post it. Each tagged person must complete Fanulu's own identity verification and approve the post before it is published. You may not post content featuring a person who has not done so.
3.4 Records. You must keep the following for every person in your content, as required by 18 U.S.C. § 2257 and 28 C.F.R. Part 75:
- a copy of their ID;
- their legal name and date of birth;
- any stage names they use;
- their signed consent.
You must keep each record for seven years from the date of its creation or last amendment or addition. If you stop producing content, you must keep the records for five years after that (28 C.F.R. § 75.4).
3.5 Producing records on request. You must give Fanulu copies of these records within five (5) business days of our request. We may remove the content, and suspend your account, until you do.
3.6 Per-post certification. Each time you post, you certify, under penalty of perjury, that:
- everyone in the content was at least 18 when it was made;
- each of them has given the written consent in 3.2;
- you hold the records in 3.4; and
- everyone other than you is tagged.
4. Review, Removal and Complaints
4.1 Fanulu screens content before publication, using automated tools with human review of anything flagged. We may refuse, remove or restrict any content at any time.
4.2 Anyone who appears in your content may ask us to remove it. If consent cannot be shown, was never given or is not valid under applicable law, we will remove the content. If we disagree that consent is not valid, the disagreement is resolved by an independent neutral third party at Fanulu's expense. You agree to cooperate with that process and to be bound by its outcome.
4.3 We review and resolve complaints within five business days. We remove content immediately when we find it to be illegal. See our Complaints Policy.
4.4 You must cooperate promptly with any complaint, investigation or records request about your content.
5. Consequences of a Breach
5.1 If you breach this Agreement, we may:
- remove content;
- suspend or permanently close your account;
- cancel your subscriptions and sales;
- withhold earnings connected to the breaching content, in proportion to the breach;
- for content involving minors, non-consent, trafficking, prostitution or escorting, close your account and withhold all unpaid earnings;
- report you to law enforcement, the National Center for Missing & Exploited Children (NCMEC) and our payment processors.
5.2 Content that appears to involve a minor, or non-consensual intimate imagery, is preserved as evidence under legal hold and reported as the law requires. It is not deleted.
5.3 You will indemnify Fanulu LLC against claims, fines, penalties and costs, including card network assessments, arising from your content or your breach of this Agreement.
6. Changes
We may update this Agreement. When we change it, you must accept the new version before you can upload or sell again.
7. Governing Law
This Agreement is governed by the laws of the State of Wyoming, where Fanulu LLC is registered, the same as our Terms of Service, and disputes are handled as the Terms describe.
